Overview

Upon signing up for CW&D's services, all customers agree to
comply with CW&D's Terms and Condition of Use. The spirit of this policy is to ensure our customers use CW&D's services with regard to the rights of other Internet users, conform with the requirements of CW&D's network environment and applicable legislation.
Please note that asterisked items (*) are not applicable to Dedicated Server customers.
Illegal Use
 CW&D servers may only be used for lawful purposes only. Transmission, storage, or distribution of information, data, or material in violation of applicable law or regulations is strictly prohibited. This includes, but is not limited to: copyright material; trade marks; registered or unregistered designs, confidential information and any other intellectual property rights used without proper authorization; material that is obscene, defamatory, which constitutes an illegal threat, or violates export control laws. Sites or links which contain or enclude pirated software, hacker programs or archives, Warez sites, MP3, and IRC bots are strictly prohibited.
Adult Content
 Due to the special system and network requirements of sexual (Adult)-oriented sites, sitew which contain or have links to pornographic materials or materials of a sexual nature or sex-related merchandising are prohibited. This includes sites which provide links to sexual (adult) sites elsewhere on the Internet. This is also true for sites which promote illegal activity or contain programmes which may be damaging to our servers or other servers on the Internet.
Security
 Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
Server Resources*
 Any web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a Dedicated Server plan. CW&D shall be the sole arbiter of what is considered to be a high server usage level. Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down immediately and without prior notice. The customers of such websites will be notified within 24 hours of this decision. In such an event CW&D will not be liable for any loss suffered by the customer as a result of the website shutdown.
CGI Scripts*
 CGI script sharing with domains not hosted by CW&D is not permitted. Any CGI-scripts deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.
Chat Rooms*
 CW&D does not allow customers to install their own chat rooms. Chat rooms tend to require significant system resources and therefore cannot be permitted as an account option. However, for a small charge, CW&D provides Java chat rooms that meet most users' needs and run without hindering system performance.
Background Running Programs and Cron Jobs*
 CW&D may allow programs to run in the background. These programs will be considered on an individual basis and customers will incur extra charges based on system resources used and operational maintenance needed. If you wish to run background programs please contact CW&D at support@computerworks.co.uk so that we can arrange set-up.
IRC
 CW&D does not allow IRC or IRC bots to be operated on our servers.
UCE (Unsolicited Commerce Email) - SPAM
 Spamming, the sending of unsolicited mass email from or through a CW&D server or using an email address that is maintained on a CW&D machine is STRICTLY prohibited. CW&D will be the sole arbiter as to what constitutes a violation of this provision. Customers are also in violation of this provision if they engage in spamming using the service of another ISP or IPP, but channel activities through a CW&D server as a mail drop for responses. Violators (spammers) will be charged a minimum fine of GBP£500 and will have all services provided by CW&D immediately suspended. Any such customers will be notified within 24 hours of this decision. In such an event CW&D will not be liable for any loss suffered by the customer as a result of the suspension of their services.
Server Abuse
 Any attempts to undermine or cause harm to a CW&D server or customer's Site or services are strictly prohibited. Customers who are found to have intentionally undermined or cause harm to CW&D Servers or to the services provided by CW&D to its customers, shall have their services immediately suspended without notice. Any such customers will be notified within 24 hours of this decision. In such an event CW&D will not be liable for any loss suffered by the customer as a result of the suspension of their services.
Software Distribution*
 CW&D's shared web hosting accounts are not configured for the purposes of distributing software and/or multimedia products. If you wish to distribute software and/or multimedia files, please contact suport@computerworks.co.uk to make special arrangements.
Multimedia Files*
 Multimedia files are defined as any graphics, audio, and video files. CW&D shared web hosting accounts are not to be used for the purposes of distributing and storing unusual amounts of multimedia files. Any web site whose disk space usage for storing multimedia files exceeds 65% of its total usage, in terms of total size or number of files, will be considered to be using an unusual amount of multimedia files.
Databases*
 Any database stored on CW&D's servers shall be limited in size to 15% of the total disk space allotted for that particular domain's plan/web hosting account.
Copyright Violations
 If you would like to notify CW&D of any infringement of your copyright send your notification to CW&D's designated agent. You may choose any of the following three avenues for this notification: Email to abuse@computerworks.co.uk. Data Back-Up
 CW&D is not responsible for backing up (duplicating) data files of any kind on its servers and will not be liable for loss, damage or injury to any data stored on its servers. It the responsibility of CW&D's clients to have back-up (duplicate) copies of any data placed on CW&D's servers at all times.
Actions Taken by CW&D
 The failure by a customer to meet or follow any of the above Terms of Use or who may be in breach of applicable law is grounds for account deactivation. CW&D will be the sole arbiter as to what constitutes a violation of the Terms of Use. CW&D reserves the right to remove any account without prior notice. When CW&D becomes aware of an alleged violation of its Terms of Use, CW&D will initiate an investigation into the alleged violation. During the investigation, CW&D may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, CW&D may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offence, CW&D will notify the appropriate law enforcement authorities. CW&D does not issue credits for outages incurred through service disablement resulting from Terms of Use violations. In such an event CW&D will not be liable for any loss suffered by the customer as a result of the suspension of their services. CW&D customers agree to indemnify and hold harmless CW&D from any claims resulting from the use of our services that damages them or any other party. The CW&D service is provided on an as is, as available basis. CW&D expressly disclaims any representation that the CW&D service will be error-free, secure or uninterrupted. CW&D and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
Modification
 CW&D reserves the right to add, delete, or modify any provision of its Terms of Use at any time without notice.
